PoppyseedNYC LLC (“Poppyseed”, “us”, or “we”), is the owner (“Site”). We are committed to protecting your privacy and the security of all data on the Site. To demonstrate this commitment, we have adopted this privacy policy ("Policy"). This Policy is based on the principles of notice/awareness, choice/consent, access/participation, and integrity/security in the collection and use of all information regarding our users and their activities on the Site. By accessing the Site, you are agreeing to the practices described in this Policy. Any changes to this Policy will be effective immediately upon posting to the Site.

Registration is not required, but it is optional and will speed and simplify online shopping for returning visitors. During registration you are required to give contact information (such as your name and email address). We use this information to contact you about your order. When you register, you will receive a confirming email.

If you purchase a product or service from us, we will request certain personally identifiable information from you on our order form. You must provide contact information (such as name, email, and shipping address) and payment information (such as credit card number, billing address, and expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. When you place an order, you will receive a confirming email from us and may receive an additional confirming email with shipment tracking information if USPS Priority Mail is selected for method of shipment.

Poppyseed collects your information to facilitate your participation in the activities you select and to prevent fraud and unlawful use. If you purchase our granola, the information is used to fulfill your order. Your personal information may also be used to track customer preferences to provide a customized Site experience. Poppyseed may collect information about the use and ordering of our products and services and the Site, including, without limitation, product ordering information, types of services used, how many users we receive daily, Site pages visited, and the internet protocol (“IP”) address of your computer. By submitting your data, you expressly consent to such uses. This information is generally collected in aggregate form without identifying any user individually, although IP address in relation to purchases and downloads may be tracked as part of Poppyseed’s customer order review and fraud prevention efforts. Poppyseed may use aggregate, nonidentifying statistical data for improving the Site and our products and services to provide more relevant experiences to our customers and for statistical analysis.

Customer Service

Based upon the personally identifiable information you provide us, we will send you a welcoming email to verify your username and password. We will also communicate with you to respond to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your selection.

We store information that we collect through cookies and log files to create a “profile” of your preferences. We tie your personally identifiable information and your purchasing history to information in the profile in order to improve the content of our Site for you. We do not share your profile with any third parties.

We share aggregated demographic information about our user base with our partners and advertisers. This information does not identify individual users. We share it in order to provide relevant partner content to our visitors. We do not link aggregate user data with personally identifiable information.

We do not share personally identifiable information with third parties except as described in the “Service Providers” and “Legal Disclaimer” sections below.

We may use third parties to provide shopping cart, shipping, credit card processing, and email list management on our Site. When you sign up for mailing lists or order items online, we will share names, email addresses, shipping address, and credit card information as necessary for such third parties to provide the applicable service.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Site.

We provide you the opportunity to “opt-out” of having your personally identifiable information used for certain purposes when we ask for such information. For example, if you purchase granola but do not wish to receive any marketing material from us, you can indicate your preference on our order form. If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the instructions included in each newsletter or promotional communication.

We gather certain information automatically and store it in log files. This information includes IP addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site, and to gather demographic information about our user base as a whole. We do not link this automatically-collected data to personally identifiable information. We use a third-party tracking service, Google Analytics, that uses cookies and log files to track non-personally identifiable information about visitors to our Site in the aggregate including page visits, times, and referrers to the Site in order to monitor and enhance our Site content.

This Policy is governed by the laws of the State of New York in the United States, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Policy shall lie exclusively with the state and federal courts within the State of New York. If any provision of this Policy is held to be invalid or unenforceable, then the invalid or unenforceable provision shall be deemed superseded by a valid, enforceable provision most closely matching the intent of the original provision and the remainder of this Policy will continue in full force and effect. UNDER NO CIRCUMSTANCES SHALL WE HAVE ANY LIABILITY FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR SPECIAL DAMAGES ARISING OUT OF THE BREACH OF THIS POLICY, HOWEVER OCCASIONED.
